To obtaining asylum in France


Asylum seekers in France have become the target of many asylum seekers after France announced an increase in the number of applicants for asylum since the beginning of 2016 and until the end of May, despite the sharpness of Europe on its borders.

Law No. 1176 of 10/12/03 on asylum law combines asylum procedures through the French Office for the Protection of Refugees and Stateless Persons (l'OFRA) (Chapter 1, 2 and 4).
Finally, the French Office for the Protection of Refugees and Stateless Persons, L'OFPRA, explains that a foreigner may benefit from the protection of precautionary protection or the status of a refugee.

Request for asylum upon entry to France
If you wish to enter France in an asylum you can tell the security authorities at the airport, at the port or at the first arrival station. If you enter the road, you should go to the nearby employment office to obtain the asylum application form.

You must provide:

  • • All information related to your civil status.
  • • Any document proving that you have entered France legally or all information about the conditions of your entry into France and your travel route from your country of origin.
  • • 4 images defined
  • • The address to which any correspondence can be reached.

You will receive a temporary residence permit, under the name of "under consideration by the French Office for the Protection of Refugees and Stateless Persons" OFFPRA, valid for one month. You will find a refugee status application form which you must return to the French Office for the Protection of Refugees and Stateless Persons. Upon submission of the certificate of deposit of the application for recognition as a refugee or since the registration of this application by the French Office for the Protection of Refugees and stateless persons, you will receive a request for asylum equivalent to the temporary residence permit. The name of the "delivery of D to the filing of refugee status application". Valid until reported by the French Office for the Protection of Refugees and Stateless Persons.
A request for a provisional license can be rejected in the following cases:

  • • If your file research reveals that another country is interested in implementing international conventions.
  • • If you are entering another country where you are protected from expulsion to your country of origin.
  • • Your presence is a serious threat to public order.
  • • Your request for asylum is delusional and fraudulent, either you have given it by false identity, or you have submitted it to obstruct the deportation measure taken or to take action against you.

Local asylum application:
Law No. 1176/2003 on 10/12/03 on the right to asylum (JO du 11) created the precautionary protection. Since January 1, 2004, these have replaced domestic asylum (Chapter 1 and 7).
1) The local asylum application was submitted before 01/01/2004. The consideration of this application is subject to change if you applied simultaneously to the OFPRA which was not broadcast before January 1st.in this case, subject to the new rules.
2) The application was submitted before January 1st, 2004. You may benefit from this application if you make another application to OFPRA.
The precautionary protection is given to all persons who do not have the conditions of refugee status ... and who prove that they are at risk of the following serious damage:

  • • The death penalty.
  • • Torture, inhumane or inhumane punishments or breaches of Chapter 3 of the European Convention for the Protection of Human Rights and Fundamental Freedoms.
  • • In the case of a serious threat, both direct and individual, against a person's life or personality due to general violence resulting from internal or international armed conflict.
  • Due to persecution and a refugee status grant, the State party, parties, bodies that monitor the State or part of the territory of the State, or non-public actors in the case of refusal or inability to provide protection shall be given prompt protection by the State.

The French Office for the Protection of Refugees and Stateless Persons is obliged to grant restorative protection when conditions are available:
You must apply for protection to the workers in which you live. The request for protection is equivalent to the residence document. You receive a form of employment. You must provide information related to your civil status, the reasons for your application and the documents proving your legal entry into France.
When listening to you in employment, you can ask for help from a translator or anyone you choose. You receive a delivery equivalent to your residence permit. Which does not allow you to work.
The worker sends the request, written report and opinion on the matter to the Minister of the Interior, who in turn sends it to the Ministry of Foreign Affairs for information. If the Minister of the Interior agrees to grant you restorative protection, the worker will give you, your husband or spouse and your minor children a temporary residence card entitled "Private and Family Life".
The restorative protection is utilized for a full year renewable.
The Office may, at its own initiative or at the request of the State representative, re-examine the file and may withdraw the use of protection for subsequent reasons and may refuse to renew the protection if it considers that the conditions for which it was submitted are no longer available or have undergone a profound change.
For serious reasons, protection is not granted to a person who:
1) Commits a crime against peace, a war crime or a crime against humanity.
2) Committed a serious crime in the general right.
3) the offender is considered to be acting against the purposes and principles of the United Nations.
4) whose presence on the national territory represents a serious threat to public order, public security or State security.
On the basis of its initiative or at the request of the State representative, the Office may reconsider and may at any moment withdraw protection for the above mentioned reasons.

Request for asylum:
An application must be submitted to the French Office for the Protection of Refugees and Stateless Persons directly or in writing, and the application form must be submitted to the employment, including detailed reasons for the applicant's refugee status.
Documents to be submitted are:

  • • All civil status documents.

When you apply to the French Office for the Protection of Refugees and Stateless Persons, or after registration of your application, you must contact the employer in order to deliver the application for three months and the residence permit is equivalent. When you enter France as a refugee and have a long-stay visa, you arrive with a "foreigner in asylum" visa valid for 6 months. If a period of one month has elapsed since the temporary residence permit has been delivered and the French Office for the Protection of Refugees and Stateless Persons has not delivered the certificate of the filing of a refugee status application or has not been registered, the decision to cancel the residence is taken.
Appeal in case of cancellation of refugee status application.
You can appeal to the Refugee Appeals Committee by sending a letter in French explaining the reasons for your refugee status.
Documents to be submitted are:

  • • The original decision of cancellation, if it is made by a written decision of the French Office for the Protection of Refugees and Stateless Persons (a copy of which has been retained).
  • • A copy of the refugee status application in the event that it does not receive an answer from the French Office for the Protection of Refugees and Stateless Persons.

You must submit an appeal in the month following your receipt of the cancellation decision by the French Office for the Protection of Refugees and Stateless Persons.
By submitting the appeal or registering it with the Refugee Committee against the negative decision of the French Office for the Protection of Refugees and Stateless Persons, you will receive a renewal of the application for asylum, valid for three months and renewable to the media by decision of the Appeals Committee.
Your comments can be submitted orally during your case by the Refugee Appeals Board, and you can consult a lawyer and seek legal assistance.
If the Commission cancels the decision of the French Office for the Protection of Refugees and Stateless Persons, the latter must give you a refugee certificate that allows you to apply for a resident card pending residence and employment permits.
If the committee rejects your appeal, you are not considered an asylum seeker and you do not have the right to reside. After the time has elapsed, you must leave the French territory.

Statelessness:
A stateless person is considered to be a person who has no nationality or is no longer available. A stateless person may be submitted to any person who is not considered a national by any State. The procedures for obtaining this status are the same as the procedures for refugees with two different points:

  • • The appeal against the decision of the French Office for the Protection of Refugees and Stateless Persons is not submitted to the Refugee Appeals Committee but to an administrative court in your place of residence.
  • • When a stateless person is granted a residence card of one year.

Rights of asylum seekers and refugees:
Merger compensation
You can take advantage of them if you have a refugee card or since the delivery of your asylum application.
The amount of the reintegration compensation is € 9,55 per day. It has been awarded to you since you registered as a student. The merger compensation is not finished and does not stop. Offers you fully if your monthly income is limited to:

  • • 573 and 859.50 euros per person.
  • • 1432,50 and 1719 for the couple (amounts applied as of 01/01/2003).

Consolidation compensation is offered for a maximum of one year, divided into two months, renewed after consideration of your status by DDTFP
To take advantage of them, you must register on the list of job applicants at the SACEDIC ASSEDIC. The application must be filed within two months after you register as a student or on the date of your availability on the terms of your application. After this period, ASSEDIC transmits your file to DDTFP, which may give you access to or reject the integration compensation.
You can collect integration benefits with income in the event of a short-term or seasonal career (paid or not). Except in special cases where it can be combined for 12 consecutive months or intermittent starting from the beginning of the activity divided into 12-month phase. If you are a contractor, you have the right to compensation for integration for 6 months starting from the date of formation.
Travel document:
You can take advantage of them if you have a refugee certificate or a valid stateless certificate and allow refugees and stateless persons to travel outside France without entering their country of origin.
Children under the age of 15 can have an individual travel document or register in a travel document for someone other than the age of the person (and if they are under the age of 15).
The validity of the travel document is two years. You must be returned to France before the travel document expires and can be extended by the French consulates.
To obtain or extend a travel document, you should go to the police commission or to the Paris labor force.
Documents to be provided are:

  • • 8-euro tipper.
  • • Original residence card and a copy (copy of both letters).
  • • A certificate of refugee and stateless person and a valid copy (copy of both cases).
  • • Two photographs of the application and one image of the extension, less than 3 months.
  • To enroll your children under the age of 15:
  • • A copy of the child's contract of increase
  • • Administrative certificate issued by the French Office for the Protection of Refugees and Stateless Persons, valid for 6 months.
  • • Residence document and refugee certificate for parents.
  • • A recent picture if the child is under the age of 7 years.
  • • License by a legitimate representative provided by the employment
  • In the event of divorce or guardianship, a copy of the judgment shall be submitted and certified.
